Wrongful Death

You Deserve Answers and Accountability

Losing a loved one because of someone else’s negligence is one of the most devastating things you can experience.  While no amount of compensation can undo that loss, Pennsylvania law allows you to hold the responsible party accountable and recover for what you’ve lost.  Wood Legal is committed to helping families through this difficult process with both compassion and aggressive advocacy.

What Pennsylvania Law Requires

Under Pennsylvania’s Wrongful Death Act, a claim may be brought when a person’s death is caused by the wrongful act, neglect, or negligence of another.  The claim is filed by the personal representative of the deceased person’s estate, but the right to recover belongs to specific surviving family members: the spouse, children, and parents of the deceased, in that order of priority.

Pennsylvania also allows a separate but related claim, known as a survival action, which recovers damages the deceased person could have pursued had they survived, such as their pain and suffering, lost wages, and medical expenses between the time of injury and death.  Wrongful death and survival actions are often pursued together to seek the fullest possible recovery for a family.
